ALAN F. KAUFMAN
PROFILE
Alan Kaufman is Of Counsel in the New York office of McKenna Long & Aldridge LLP. He has broad experience in all aspects of complex civil litigation in New York, New Jersey and Pennsylvania State and Federal courts. His practice includes securities, products liability, insurance coverage, collection matters, executory contract disputes, creditors’ rights, insolvency and foreclosures, as well as intellectual property defense and prosecution.
In the course of his practice, Alan has litigated a large variety of disputes and, as a result, filed and argued a multitude of legal motions on numerous issues. In this capacity, he has litigated a wide range of discovery issues, such as subpoena responses and subpoena prosecutions, as well as motions to compel the production of documents and deposition testimony. He has also handled the production of enormous volumes of e-mails and other electronic documentation.
In addition to litigating on his clients’ behalf, Alan also counsels clients on ways to avoid litigation, including conducting factual and legal investigations prior to litigation being filed.
Litigation Experience
Alan’s litigation practice consists of experience in a wide variety of matters, including:
- Prosecuted numerous claims on behalf of governmental entity against sole shareholder of failed insurer and alleged co-conspirators, as well as professional liability claims against auditors, accountants and actuaries;
- Represent mortgage lender in variety of lender liability actions, including defending allegations relating to sub-prime mortgage issues;
- Defended bank and its directors against insurgent shareholders seeking to “sterilize” voting right during proxy contest for election of directors;
- Worked on complex insurance coverage litigations relating to various lawsuits arising out of the flooding of City of New Orleans during Hurricane Katrina;
- Represent international modeling agency in connection with various contractual and intellectual property matters;
- Pursued claims in workout on behalf of Wall Street bank in connection with jumbo mortgage backed securities deal; and
- Represented landlord in executory contract dispute.
Intellectual Property Experience
Alan’s practice has particular focus in intellectual property matters, including;
- Prosecute and defend infringement actions in relation to intellectual property in various industries, including use of logos on apparel and use of trademarks in motion pictures;
- Prosecute trademark applications before the United States Patent & Trademark Office;
- Prosecute and defend cancellation and opposition proceedings before the Trademark Trial and Appeal Board;
- Counsel clients in developing branding strategies, and consulting with foreign counsel to address clients’ intellectual property needs overseas; and
- Negotiate, draft and analyze various types of settlement, co-existence, software and licensing agreements, including those related to apparel, media, software, domain names and modeling.
