Kevin Slattum, a partner at McKenna Long & Aldridge's Los Angeles office, focuses on a wide range of government contract issues touching on nearly all aspects of federal government procurement law, including contract disputes, government cost accounting and recovery, subcontract disputes, bid protests, and fraud/false claims defenses. He has shepherded clients “from the cradle to the grave” in the process of making successful Requests for Equitable Adjustments (REAs) and contract claims against the government utilizing a broad range of legal theories, including contract interpretation, government interference and out-of-scope direction, defective specifications, government-caused delays and numerous other related grounds. He has litigated cases totaling more than $300 million involving many government agencies including DoD and NASA, and arising in a variety of contexts, including high technology space and satellite procurements, A-76 outsourcing issues, Service Contract Act (SCA) issues, smart weapons and other high-technology manufacturing issues. As part of this practice, Kevin has represented clients in a variety of fora, including the Armed Services Board of Contract Appeals and other administrative boards, federal district and appellate courts, the Comptroller General of the General Accounting Office, state courts and in private arbitrations and mediations.
Kevin’s additional expertise focuses on counseling clients and obtaining cost recovery in the context of Federal Acquisition Regulation (FAR) cost allowability, Truth In Negotiation Act (TINA) and CAS issues. He also has extensive experience litigating and resolving prime-subcontractor disputes. Kevin has frequently counseled and defended government contractors facing allegations of fraud or related misconduct, including cases brought by the government or qui tam realtors under the False Claims Act (FCA) in the contexts of environmental remediation and testing, major weapons systems development, cost mischarging and mistesting. He has litigated cases brought under related Racketeer Influenced and Corrupt Organizations (RICO), conspiracy, mail fraud and wire fraud theories in the context of small business (SBA) government contracting. He has also assisted clients in resolving organizational conflict of interest (OCI) issues and in preparing OCI firewall plans. Kevin’s related commercial litigation experience includes matters relating to trade secrets, contract disputes, UCC issues and unfair business practices. He has also counseled numerous clients on compliance and investigation issues and assisted them in responding to Inspector General (IG) subpoenas.
Kevin received his J.D. degree, magna cum laude, from Pepperdine University School of Law, where he served as an associate editor of the Pepperdine Law Review and was a quarterfinalist in the Dalsimer Moot Court competition. In a “previous life,” he was the chairperson of the English Department and a volleyball coach at Crespi High School in Encino, California, as well as an assistant basketball coach at Thousand Oaks High School in Thousand Oaks, California.
