Environmental Guidance

We regularly guide both buyers and sellers through the labyrinth of environmental regulations that affect mergers, acquisitions and divestitures in the basic manufacturing sector. This process involves identifying liabilities through environmental audits, assessing those liabilities, performing environmental due diligence to ensure transfer of permits, and drafting and negotiating contract terms to address the allocation of risks and liabilities.

We also advise and represent manufacturing and service companies in various aspects of compliance with environmental laws and regulations including hazardous waste determinations, waste minimization, air quality, wastewater compliance, site investigation and remediation and OSHA.

Product Liability and Toxic Torts

MLA has an active, national practice in product liability and toxic tort litigation, and we have defended many of the more significant multi-defendant "industry" cases. We also have successfully defended class actions.

Our products liability work includes representation of manufacturers of diverse products, including drugs and medical devices; asbestos and asbestos containing products; cellular telephones; agricultural chemicals; pesticides; petroleum-based products; hazardous waste; machinery and manufacturing equipment; and military, aerospace, and other commercial products.

Proposition 65

Our attorneys are at the forefront of the Proposition 65 defense bar in California. We represent a broad range of manufacturers, refiners, distributors and retailers of products, and have brought about some of the most significant developments in the law.

Toxic Substances Control Act

Our TSCA (Toxic Substances Control Act) team includes some of the country's leading TSCA practitioners. We counsel and represent electronics and automotive companies, among others, that use chemical products in their manufacturing processes, in addition to manufacturers and formulators of specialty chemical products for consumer use.

European Union Regulation and Litigation

Attorneys in our Brussels office counsel and litigate on all aspects of EU waste management and chemical and pesticide regulation. We have close working relationships with personnel of the European Commission and Member State Authorities, and work in association with legal and technical experts in each of the Member States.
