PROFILE

David Folds is Of Counsel in the Washington, DC office of McKenna Long & Aldridge LLP. His practice  focuses on business bankruptcies and commercial litigation. Mr. Folds represents financial institutions, landlords, franchisors, trade creditors, purchasers of assets, and other entities in all aspects of bankruptcy proceedings.

Mr. Folds also represents companies and individuals in commercial litigation, such as lending matters, contractual claims, and business torts, in state and federal courts. Mr. Folds served as a law clerk to the Honorable William L. Stocks, Chief Judge of the United States Bankruptcy Court for the Middle District of North Carolina.

Representative Cases

  • Served as lead counsel for major secured creditor in multi-day  contested confirmation hearing.

  • Defended Fortune 100 companies in numerous preference and fraudulent transfer actions.

  • Represented landlord for flagship store in chapter 11 reorganization of national retailer.

  • Served as lead litigation counsel for major agricultural distributor in multi-million dollar contract claim brought by producer and obtained summary judgment on all claims.

  • Served as lead litigation counsel for international equipment  manufacturer in dispute with distributor and obtained appointment of receiver in state court pending international arbitration.

  • Prosecuted approximately 75 voidable transfer claims on behalf of bankruptcy trustee for telecommunications company.
