PROFILE

Mark Meagher is the managing partner for the Firm's Denver Office. He represents clients in a broad array of government contracts counseling and litigation matters. Mark has substantial experience in counseling contractors on cost allowability, allocability, and recovery questions arising under the Federal Acquisition Regulation and Cost Accounting Standards. He frequently assists clients in developing responses to audit findings issued by the Defense Contract Audit Agency and other government audit organizations, such as the inspectors general. He also assists clients in resolving the full spectrum of procurement, contract administration and performance issues present in today's government contracting environment. Mark also counsels universities, healthcare organizations and nonprofit entities with issues under research grants and cooperative arrangements.

Mark has litigated many cases at the Boards of Contract Appeals and the United States Court of Federal Claims involving the full range of government contract issues, including many performance-related claims.  Mark also has successfully defended numerous government contractors against civil fraud allegations, including many cases brought under the qui tam provisions of the civil False Claims Act.  In addition, Mark regularly conducts internal investigations of alleged wrongdoing by company employees or subcontractors, both before allegations have become public and in the context of responding to government investigators or prosecutors. These cases and investigations have related to contracts awarded by both the Department of Defense and the Department of Energy. Mark's defense of cases at DOE sites have included two of the largest fraud claims ever brought against DOE contractors.

Mark's practice includes the representation of Department of Energy contractors in all aspects of their operations at DOE sites around the country. He regularly provides counsel to contractors on the unique cost allowability, performance, contract administration and liability issues present at DOE sites. He is deeply experienced in assessing issues of contract coverage and indemnity for tort, environmental clean up and other analogous liabilities that arise from government-owned, contractor-operated sites, and in particular as they relate to the unique provisions of DOE's Management and Operating contracts.

Mark is a graduate of Yale University and a cum laude graduate of Albany Law School , where he was Editor-in-Chief of the Albany Law Review.
