PROFILE

As a partner in McKenna Long & Aldridge's Intellectual Property group, Mr. Bailey concentrates his practice in the areas of patent and Intellectual Property enforcement (pre-litigation counseling, opinion work and litigation), and is a Co-Chair of the Firm’s Global Patent Litigation Group.

Recently, Mr. Bailey has handled several significant high technology patent infringement litigations before various U.S. District Courts throughout the United States and before the Court of Appeals for the Federal Circuit.  He has successfully argued Preliminary Injunction Motions, Summary Judgment Motions, and a wide variation of Discovery Motions.  Mr. Bailey also has extensive experience advocating at Markman Hearings. 

With more than 20 years of experience in the patent field, primarily  as a private practice attorney, Mr. Bailey has also worked as an attorney advisor at the International Trade Commission (ITC) handling Section 337 investigations related to computer, semiconductor and mechanical technologies. While working at the ITC, he advised the ITC on a variety of issues, including temporary and permanent exclusion orders, and also appeared before the Court of Appeals for the Federal Circuit to defend the Commission’s ultimate determinations.

Mr. Bailey currently provides counseling to a variety of clients, including numerous large multinational technology companies, on all aspects of Intellectual Property and supervises patent prosecution in a wide range of technologies.  His patent prosecution practice includes patentability and right-to-use counseling; patent drafting; sophisticated appeal, reissue and re-exam advocacy; and large portfolio management.
