Jason Carey is a Government Contracts attorney in McKenna Long & Aldridge LLP's Washington, DC office. Jason concentrates his practice on government contracts, white collar criminal defense, and commercial litigation.
Jason routinely provides counseling on compliance with government contracting laws and regulations. For example, he has provided advice on the Buy American Act; the Small Business Act and other small disadvantaged business issues; Federal Acquisition Regulation ("FAR") and FAR Supplement requirements and standard clauses; the Truth in Negotiations Act and defective pricing; Freedom of Information Act ("FOIA") and reverse FOIA issues; teaming arrangements and joint ventures; novations; subcontracts; and equal employment opportunity requirements. He has also advised clients on compliance with the Foreign Corrupt Practices Act (“FCPA”) and export control laws and regulations
Jason regularly represents government contractors in bid protests before the Government Accountability Office and the Court of Federal Claims. He also litigates government contracts claims before federal and state courts and boards of contract appeals, including a recent jury trial in the United States District Court for the Eastern District of Virginia involving claims of trade secret misappropriation, business conspiracy and tortious interference with contract. In addition, Jason defends clients under investigation by or in litigation with the federal government for violations of various federal statutes and regulations, including the False Claims Act, the Truth in Negotiations Act, FCPA, export control laws and regulations, and the Lacey Act.
Jason also regularly represents clients in various types of commercial litigation. He has litigated commercial cases in the following areas, among others: breach of commercial contract, breach of employment contract, patent infringement, misappropriation of trade secrets, and private Sherman Act antitrust claims. He has litigated cases before United States District Courts for the Eastern District of Virginia, the District of Columbia, the District of Maryland, and the Northern District of California. He has also litigated cases in Virginia state court and before the American Arbitration Association.
Jason received his J.D. from University of Virginia School of Law., where he worked as a research assistant for Professor Michael J. Klarman. Jason graduated cum laude from Williams College with a B.A. in biology and political science. While at Williams, he completed an honors thesis in political science entitled, Genetic Technology and Constitutional Law: A Jurisprudential Analysis.
