INSURANCE BAD FAITH: DESCRIPTION

In today’s litigation environment, insurers regularly face claims involving extra-contractual exposure or “bad faith.”  The Firm’s Insurance and Financial Services Group handle claims involving potential extra-contractual exposure for national and international insurers.  The Group’s experience in such matters extends across the country.  The Group also defends “set up” claims arising from settlements made by a claimant and the insured.  Although the Group recognizes the potential risks posed by such claims, it also understands the ways in which they can be successfully resolved.

Group attorneys are often asked to review pending claims involving extra-contractual exposure and to develop alternative approaches and strategies for their resolution.  Group attorneys recognize that coverage issues are important in many such claims.  However, Group attorneys understand that bad faith claims can often not be successfully resolved by focusing on coverage issues alone.  Group attorneys also focus on damages and other issues that are important to case evaluation, early resolution, and avoiding surprises.
