RIGHTS IN TECHNICAL DATA: DESCRIPTION

Our Intellectual Property practice focuses on questions of intellectual property rights -- or "technical data rights" -- when technology companies contract, or subcontract, with the federal government. Our government contract services include:

  • Counseling clients on protecting their IP rights in commercial software, software developed or customized for a federal customer and technical data -- such as drawings and documentation delivered under government contract
  • Negotiating licenses with federal agencies for commercial software, software escrows and modifications to existing software
  • Helping clients demonstrate that their software and other products satisfy the government's commercial and pricing requirements
  • Litigating against government challenges of contractors' rights in technical data and computer software.

Contract-Related Litigation

We appear before all federal courts in actions involving rights in technical data, government access to contractor records, government claims against contractors, the Freedom of Information Act and declaratory judgments regarding the rights and obligations of contractors. In both judicial and arbitration proceedings, we represent prime contractors and subcontractors in disputes arising out of subcontracts. We handle federal court litigation and international arbitrations on behalf of clients performing international government contracts.
