Clients rely on McKenna Long & Aldridge LLP to counsel them in developing bids and proposals responsive to government solicitations and in preparing appropriate subcontract terms and conditions to cover performance.
Teaming Agreements
A fact of modern federal government procurement is that frequently companies must join forces to compete for and receive award of federal contracts. Such alliances present myriad issues including addressing antitrust concerns under both the domestic and international antitrust laws. The written agreements setting up such alliances also require great care in their drafting, to insure that the parties' relationship is correctly structured and the risks and rewards of the relationship are clearly spelled out. Our practitioners have worked on hundreds of teaming agreements, analyzing the issues and their resolution in such relationships.
Subcontracts
MLA lawyers represent prime contractors and subcontractors in the formation and performance of subcontracts. We draft and negotiate subcontract provisions and provide counsel on the "flow down" provisions that prime contractors are required by law to place in their subcontracts. Our practitioners are specialists in not only the details of particular clauses, but also in the larger issues surrounding the allocation of risk and responsibility in subcontracting relationships. We frequently counsel clients on how subcontracts could be structured and written to provide for effective, and enforceable, performance by both sides to the agreement.
