Experience

Penny Cobey concentrates her practice on real estate development, infrastructure and public-private partnerships. From 2002-2004 she served the Los Angeles Unified School District as senior construction counsel to the largest public building project in the United States, charged with delivering approximately 165,000 two-semester classroom seats at an estimated cost of $12.6 billion. Her responsibilities included developing a value-based procurement process as an alternative to the District’s historic reliance on fixed-price bidding and serving as legal counsel to District source selection committees charged with development of new schools through partnership with the private sector. 

She has experience in project development and structuring, procurement, bid protests, complex design and construction contracts, insurance and land use. She speaks frequently on development issues and is a former Governing Committee member of the ABA Forum on the Construction Industry. 

Penny was recruited to California in 1998 by the J. Paul Getty Trust.  She served as the principal legal advisor to the director of the Getty Museum and also advised the Getty’s senior management on the renovation and construction of the Getty Villa in Malibu, a $200 million project.  She counseled management on intellectual property, employment, contract and real estate issues and managed over 20 outside counsel within the United States and internationally.  In addition, Penny served as Secretary and legal advisor to the Board of Trustees. 

Before joining the Getty, Penny was a partner at the Boston law firm of Hill & Barlow, which represented over 150 architectural and engineering clients as well as major developers throughout New England.

Prior to law school, Penny was a Research Associate and case writer in marketing for Harvard Business School.

  • Penny has lectured on design and construction issues to ABA Forum on the Construction Industry audiences across the United States, as well as to the American Institute of Architects, annual Build Boston expositions, public agencies, ALI-ABA programs and Yale University architectural students. Her most recent article, “Reporting and Compliance Requirements Imposed by the Recovery Act,” will be published in October 2009 in The Procurement Lawyer. Recent speaking includes:
