Experience

Frederic M. Levy has extensive experience in government contracting and compliance. His practice spans the spectrum of issues that arise from the negotiation, award, performance and termination of contracts. Mr. Levy's particular focus is the resolution of complex compliance and ethics issues. He has represented and advised numerous corporations under investigation by the government or in the conduct of internal investigations, particularly in the areas of program fraud and export controls.

Mr. Levy represents large and small companies doing business with many federal agencies. His practice includes counseling, the preparation of contractor claims, and the resolution of performance disputes. He has resolved such disputes in arbitration, mediations, and in litigation before the various boards of contract appeals and federal courts.

Mr. Levy's program fraud practice includes both criminal and civil matters. He counsels and represents clients during all aspects of the criminal process, and also has substantial experience in civil False Claims Act/qui tam actions. He has defended clients in such matters at both the trial court and appellate court levels. His practice includes the defense or investigation of matters involving cost mischarging, product substitution, quality issues, kickbacks, conflicts of interest and misappropriation of government or classified information. Mr. Levy's export controls practice includes the representation of corporations in matters involving alleged violations of the ITAR, FCPA, OFAC regulations, or anti-boycott rules in the conduct of international trade.

Mr. Levy has conducted numerous internal investigations on behalf of corporate clients. He has investigated allegations involving program fraud or export issues, and has been engaged to conduct investigations involving sensitive personnel or fiduciary matters. He also has advised corporations in voluntary disclosures to a variety of federal agencies.

Related to his work involving program fraud, Mr. Levy counsels clients in the area of contractor "responsibility."  He is involved in the development and implementation of contractor ethics and compliance programs which meet the standards of the Federal Acquisition Regulation, Federal Sentencing Guidelines, and Sarbanes-Oxley, and regularly conducts ethics and compliance training. He also represents contractors and individuals who have been suspended or proposed for debarment. He is Co-Chair of the ABA Committee on Debarment and Suspension and of the Procurement Fraud Committee and a contributing author and editor of the Practitioner's Guide to Suspension and Debarment and of Healthcare Exclusions: A Comprehensive Guide.

Mr. Levy also has extensive experience with commercial dispute resolution issues. This includes federal and state court litigation and arbitration, particularly involving software development and technology issues.
