Experience

Michael G. Scheininger practices in the areas of criminal defense and general civil litigation. He is an adjunct professor of law at the Georgetown University Law School, teaching in the areas of trial practice and advocacy.

Scheininger's focus is on the defense of business crimes and civil fraud. Healthcare, procurement, and other government program fraud and qui tam cases constitute the majority of his case load. He defends companies and individuals accused of SEC violations, export control offenses, violations of the Food, Drug & Cosmetic Act, and environmental crimes. Scheininger has also represented attorneys investigated for their professional representational activities.

He defends individuals and corporations in Foreign Corrupt Practices Act cases. He performed an independent FCPA investigation for the Justice Department on behalf of prospective foreign and domestic joint ventures partners.

Scheininger’s procurement fraud practice concerns proprietary data/conflicts of interest, cost mischarging, product substitution, and defective pricing. 

His healthcare practice involves the defense of medical device manufacturers and individuals accused of criminal FDA violations. He also represents pharmaceutical manufacturers, physicians and corporate healthcare providers accused of kickbacks and fraudulent Medicare/Medicaid billing.

Revenue recognition, insider trading and books/records violations of the securities statutes are at issue in Scheininger’s SEC matters.

In addition to criminal cases, Scheininger has a varied civil litigation practice.
His civil trials involve trade secret, intellectual property, and licensing issues.

Scheininger frequently is retained to conduct sensitive internal investigations and structure corporate compliance programs based on Sarbanes-Oxley and the Federal Sentencing Guidelines.

He served as an Assistant United States Attorney for the District of Columbia. He received his J.D. from the University of Pennsylvania, where he was a member of the Editorial Board of the University of Pennsylvania Law Review. Scheininger is the recipient of Georgetown University Law School's 2002 Distinguished Adjunct Professor Award.

Mr. Scheininger holds a top secret security clearance.
