Experience
Ross Hyslop is a Partner resident in the San Diego and Los Angeles offices of McKenna Long & Aldridge LLP, where he specializes in the defense of Fortune 500 companies in complex commercial and business litigation, especially consumer class and employment class actions. He has defended class action lawsuits not only throughout California, but also in federal and state courts in Wisconsin, Illinois, Florida, New York, and Pennsylvania.
His consumer class action cases typically focus on unfair competition, false advertising, unjust enrichment, breach of contract, breach of implied and express warranties, good faith and fair dealing, consumer legal remedy statutes, fraud/intentional misrepresentation, injunctive relief, negligence, and private attorney general statutes. His employment class cases typically focus on wage and hour claims under state and federal law, including litigation of overtime exemptions/rights, off-the-clock allegations, meal and rest period rights, wage statement violations, expense reimbursement/indemnity rights, unlawful deductions, termination rights, wage vesting claims, commission chargebacks, benefit/wage forfeitures, interpretation of employment manuals, employee rights under employer policies and procedures, wage order violations, and private attorney general statutes.
Hyslop’s practice has also included the representation of businesses and individuals involved in trade secret and confidentiality litigation, such as established businesses seeking to protect their trade secrets and confidential information as well as start-up businesses and founding individuals accused of misappropriating trade secrets and confidential information of their former employer. He has also litigated restrictive non-compete, non-solicitation, and anti-raiding agreements both from the standpoint of those trying to enforce them as well as those trying to defeat them.
An experienced civil litigator, Hyslop has tried class and individual actions, and has argued several appellate cases at the United States Court of Appeals for the Ninth Circuit and the California Court of Appeal for the Second and Fourth Appellate Districts.
He is admitted in all California courts, as well as the Southern, Central, and Eastern United States District Courts, and the Ninth Circuit Court of Appeal.
At the firm, Hyslop is the Team Leader of the San Diego office’s litigation department, and serves as the Hiring Partner for the San Diego office.
